Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of ultraviolet radiation exposure from a Class
IV laser:
a) Employees working in the area of where a Class IV laser is used to test
probes
manufactured by the employer, used in ophthalmic surgery, were exposed to
the hazard
of an improperly contained Class IV laser on or about October 5, 2006. The
employer
did not institute a laser safety program as described in the American
National Standard
of Safe Use of Lasers Z136.1 (2000).
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
ABATEMENT NOTE: A laser safety program as described in the American
National Standard
of Safe Use of Lasers Z136.1 (2000), includes the following:
1) Designating a laser safety officer to oversee safety for all operating,
maintenance and
servicing situations.
2) Training employees regarding the hazards of laser light exposure.
3) Calculating a nominal hazard zone for the laser.
4) Implementation of a medical surveillance and establishing a class IV
laser controlled area,
using the information from the calculations of the nominal hazard zone.
