Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: In the following instances, the employer did not comply with ANSI Z245.1: a)Clause 6 section 6.1.5 Maintenance Program - The employer did not provide a safe method of cleaning the tailgate seal after each refuse ejection. b)Clause 9 section 9.2.1 Safety Program - The employer did not have a program that included, at a minimum, the following elements: 1)A Hazard assessment in which the employer conducts a review of the various types of collection and transportation equipment which the employer utilizes and the hazards associated with them, including sampling or measurements, where appropriate, to the type of hazard, as well as the persons who may potentially encounter these hazards; 2)An evaluation of the means and methods of controlling the hazards identified in the hazard assessment, including information such as industry and regulatory requirements; instructions for the operation, inspection,m and maintenance of equipment nd literature, surveys, and other information appropriate to the hazards that are identified; 3)A written program, based upon the hazard assessment and evaluation to include procedures for the operation, inspection, and maintenance of equipment, prohibited practices, recordkeeping, training requirements, and normative references to documents, such as operating manuals, that are relied upon and may be required as part of that program; 4)A program, conforming to clause 9.3, for the implementation of the written program; and 5)Periodic reviews and program revisions as necessary to ensure the effectiveness of the safety program. Among other methods, one feasible method of abatement for the following instances is: a) Fabricate or purchase a long handle tool to clean refuse or debris remaining on the tailgate seal and container body so as both can mate properly upon reaching the closed position in order to prevent damage to the seal and leakage of refuse fluids; and b) Develop and implement a safety program in accordance to ANSI Z245.1 to ensure the employees' safety. Outside resources designed to provide low or no cost assistance in developing the program are available.
