Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to a fall hazard of 12-feet:
a)facility, on March 9, 2006 a laborer was observed standing on a pallet
of hydro-
spray mulch which was raised in the air by a forklift.  The employee was
transferring the bags of mulch from the pallet to the top of truck #15.
No fall
protection was provided and the employee was exposed to a fall of 12-feet
to the
gravel lot.
b)facility, on March 9, 2006 while loading truck #15 a laborer was observed
standing on the top rail of the guardrail provided around the top of the
truck.
The employee was exposed to a fall of 12-feet to the ground below.
Among other methods, one feasible and acceptable method to correct these
hazards is to have the employee remove the bags from the pallet while
standing
on the top of the truck which is guarded by a standard railing.
