Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of development of undetected fibrotic lung disease
(silicosis) from
inhalation of crystalline silica:
(a)At the BP Texas City worksite, in FCCU #1, where a craftsman was
exposed to
an 8-hour time-weighted average of 0.96 milligrams per cubic meter of
respirable
dust containing 32.0quartz.  The Permissible Exposure Limit (PEL) for
respirable dust containing 32.0quartz is 0.294 milligrams per cubic
meter.
Sampling was conducted for 149 minutes during the first shift on March 30,
2007.  Zero exposure was assumed for the remaining 331 minutes. The
employee
was not included in a medical surveillance program for exposure to
crystalline
silica.
(b)At the BP Texas City worksite, in FCCU #1, where a craftsman was
exposed to
an 8-hour time-weighted average of 2.39 milligrams per cubic meter of
respirable
dust containing 28.0quartz.  The Permissible Exposure Limit (PEL) for
respirable dust containing 28.0quartz is 0.333 milligrams per cubic
meter.
Sampling was conducted for 145 minutes during the first shift on March 30,
2007.  Zero exposure was assumed for the remaining 335 minutes. The
employee
was not included in a medical surveillance program for exposure to
crystalline
silica.
(c)At the BP Texas City worksite, in FCCU #1, where a craftsman was
exposed to
an 8-hour time-weighted average of 2.68 milligrams per cubic meter of
respirable
dust containing 25.0quartz.  The Permissible Exposure Limit (PEL) for
respirable dust containing 25.0quartz is 0.37 milligrams per cubic
meter.
Sampling was conducted for 99 minutes during the first shift on March 30,
2007.
Zero exposure was assumed for the remaining 381 minutes. The employee was
not included in a medical surveillance program for exposure to crystalline
silica.
(d)At the BP Texas City worksite, in FCCU #1, where a craftsman was
exposed to
an 8-hour time-weighted average of 0.666 milligrams per cubic meter of
respirable dust containing 21.0quartz.  The Permissible Exposure Limit
(PEL)
for respirable dust containing 21.0quartz is 0.435 milligrams per cubic
meter.
Sampling was conducted for 139 minutes during the first shift on March 30,
2007.  Zero exposure was assumed for the remaining 341 minutes. The
employee
was not included in a medical surveillance program for exposure to
crystalline
silica.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to provide pre-placement baseline medical examinations to
employees who are
potentially exposed to crystalline silica at one-half the exposure limit
or more (regardless of
respiratory protection) which contains the following elements:
1.A baseline chest X-ray, pulmonary function test, and an occupational and
medical
history.
2.A chest roentgenogram (X-ray), posteroanterior 14"x17" or 14"x14",
classified according
to the 1980 ILO International Classification of Radiographs of
Pneumoconiosis (ILO,
1982), and read by a board-certified radiologist of certified class "B"
reader.
3.The medical examination emphasizing the respiratory system and a chest
X-ray shall be
given every three years to workers who have less than 15 years of
crystalline silica
exposure, every two years if the worker has 15 to 20 years of exposure,
and annually if
the worker has 20 or more years of exposure.
4.With a positive chest X-ray (1/0 or greater) the worker shall be placed
in mandatory
respiratory protection, or if already wearing a respirator, the program
shall be re-
evaluated to assure proper fit and that other elements of 29 CFR 1910.134
are being met.
5.The worker shall be referred to a physician specializing in lung
diseases for a medical
evaluation and medical monitoring as warranted by the examining physician.
6.All medical test result shall be discussed with the worker by the
physician.
