Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in a forklift in case of tipping and/or rollover: a)Peter E. Reid Stevedoring, Inc. Port of Pago Pago: An employee operating the Caterpillar Forklift #25 (Model DP50K) was not wearing his seatbelt. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER SEATBELT USE.BELT
