North Carolina General Statute 95-0129(1) of the Occupational Safety and
Health Act on North Carolina: The
employer did not furnish to each of his employees conditions of employment
and a place of employment wich
were free from recorgnized hazards that were causing or likely to cause
deaht or serious physical harm to
employee in that employees were exposed to being struck by or caught in
between rollover protection mounted
to the power industrial truck:
a)establishment,  the installed rollover protection in the event employee
was thrown off the
power industrial truck was not provided with seatblts installed per
manufacturer requirements
based on seatbelt anchoring plates being installed exposing the operator
to being caught in
between/crushed from not being able to used seatbelts for the "Dattsun"
power industrial truck
which had its seat belts removed.
Among other methods, one feasible and acceptable abatment method to
correct this hazard is to install, train,
and require employee to wear seatbelts.
