Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Among other methods, one feasible and acceptable method to correct this hazard is: Follow the manufacturer's safety instruction related to the Werner fiberglass extension trestle ladder. a.On or about December 7, 2007, at the outside rotunda spiral staircase, the employer did not follow the Werner manufacturer's safety instruction as related to the Fiberglass extension trestle ladder, in that the ladder was not placed at the manufactures appropriate angle and did not extend 3 feet above the landing level. b.On or about December 7, 2007, at the outside rotunda spiral staircase, the employer did not train employees on the manufacturer's safety instructions related to the Werner extension trestle ladder.
