Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards and that were likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of airborne exposure to ozone which may result in such health effects as central nervous symptoms such as headache, irritation of the eyes and respiratory tract, asthma-like reactions, pulmonary edema, or collapse of the lungs: (a)Landry's Downtown Aquarium, 700 Water Street, Denver, CO: On or about February 1, 2008 and at times prior thereto, employer's failure to maintain the ozone generating system and components of that system exposed employees to excessive levels of ozone in the workplace. Among other methods, one feasible and acceptable method of abating this hazard is: 1.Ensure that ozone systems are only serviced by specialized personnel. Either bring in outside expertise for routine maintenance and troubleshooting or obtain training as necessary to develop in-house expertise. 2.Develop standard operating procedures with established maintenance intervals for inspecting lines and connections for leaks, for inspecting and calibrating ozone monitoring equipment and alarms, and for maintaining the ozone generating equipment. 3.Perform routine maintenance at the established intervals and perform additional maintenance as needed. 4.Provide additional training to all managers and all employees to recognize signs and symptoms of exposure to elevated levels of ozone, to recognize unsafe readings on the monitoring equipment, and to initiate immediate corrective actions. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
