Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of falling from a defective fiberglass extension ladder: a)Shop area - On November 27, 2006 an employee was exposed to a fall hazard of approximately 26 feet to the ground below while using a 40 feet fiberglass extension ladder which had damaged/cracked side rails. Among other methods, one feasible method of abatement is to: 1) Provide ladders that meet the requirements of American National Standards Institute A14.5-1982, Portable reinforced plastic ladders paragraph 9.1 which states, "Where structural defects or other hazardous defect is found, the ladder shall be taken out of service and either discarded or repaired by a competent mechanic."
