Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serous physical harm to
employees in that
employees were exposed to the hazards of asphyxiation and falls while
performing entry into
a confined space:
a)On or about May 18, 2007, at Pinery Parkway and Hillpoint Place, an
employee
entered into a sewer manhole under the following conditions:
1) without purging, inerting, flushing or ventilating the space;
2) without verifying that the conditions in the space were acceptable for
entry
throughout the duration for the entry;
3) without providing equipment such as ladders, needed for safe ingress and
egress;
4) without  retrieval equipment in the event of an emergency; and
5) without utilizing the permit system.
Among other methods, a recognized and feasible means of abatement to
correct this hazard
includes, but is not limited to, the full implementation of the elements
required by the
American National Standards Institute (ANSI) standards Z117.1 (Safety
Requirements for
Confined Spaces).

this item
