Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards when working on scaffolding exposed to physical damage. Tubular welded scaffolding was erected in areas where it was exposed to physical damage by vehicles turning and passing by the structure. One feasible and acceptable method to correct this hazard would be to ensure that the area around the exposed scaffolding was either properly barricaded to protect it against the moving traffic or ensure that proper traffic control was in place to remove the vehicles from the areas around the base of the scaffolding: A) LOCATION: CORNER OF ADAMS, CENTRAL, AND UNION ST, LEOMINSTER TUBULAR WELDED SCAFFOLDING WAS ERECTED IN AREAS WHERE IT WAS SUBJECTED TO PHYSICAL DAMAGE BY VEHICULAR TRAFFIC AND THERE WERE NO BARRIERS OR OTHER MEANS OF TRAFFIC CONTROL IN PLACE TO LIMIT THE VEHICULAR EXPOSURE TO THE SCAFFOLDING.
