North Carolina General Statute 95-129(1) of the Occupational Safety and
Health of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees, in that employees were
exposed to struck
by/caught between hazards:
a)jobsite, the employee working under the vehicle, adjusting the brakes,
was
exposed to a struck by/caught between hazard as chock blocks were not
placed
in front of the rear wheels to prevent the vehicle from moving and the
truck was
parked on a down hill grade.
Abatement note: Among other methods, one feasible methods to eliminate
this hazard would be
to require employee to use chock blocks when working on the truck.
