Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF FALLING:
a)  On or about 9/25/07 at the facility: The employee did not use the self
supporting
ladder as it was designed for use in that:
1) the employee was standing with full body weight on the top cap of the 8
foot
fiberglass ladder.
2) the employee did not ensure the portable ladder footing was level
Among other methods, one feasible method of abatement is to:
1) Use the ladder and not step on top cap as stated in ANSI A-14.5,
section 9.3.2.
2) Ensure the ladder feet are level as per ANSI A-14.5, section 9.3.4.
