Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck-by hazards:
On August 13, 2008, employees working to prepare for and clear a felled
tree were exposed
to being struck-by vehicles and suitable temporary traffic-control devices
and practices were
not used.
Traffic controls were not used as specified in the Safety Requirements for
Arboricultural Operations, ANSI Z133.1-2006, Paragraph 3.2 entitled,
Traffic
Control Around the Jobsite.
Among other methods, one feasible and acceptable abatement methods to
correct this hazard
is:
a.Ensure that employees who direct traffic are provided with suitable
paddles or
flags and provided training that enables them to recognize and control
hazards
associated with vehicles.
b.Comply with the 2003 Manual on Uniform Traffic Control Devices
(MUTCD), Temporary Traffic Controls (mutcd.fhwa.dot.gov) when
performing work that affects highway and street traffic.
***Abatement certification is required for this item in accordance with
the requirements
of 29 CFR 1903.19(c)***
