Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falling from an elevated forklift platform: Employees perform inventory of palletized stacks of cases of beverage products by standing on a pallet without fall protection, up to approximately 10 feet. The pallet provided by the employer to raise personnel with the use of a Yale forklift was not appropriate for such tasks. Among other means, one feasible and acceptable abatement method to correct this hazards is: Utilize safety platforms that meet the requirements of American Society of Mechanical Engineers, ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks, Section 7.36 entitled Elevating Platforms. NOTE: Because abatement of this violation is already documented in the casefile , the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
