Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that: employees
were exposed to fall and struck by hazards.
Location: On collection routes
On or before June 3, 2007
a) Employer failed to conduct a hazard assessment of the various types of
collection equipment
utilized and the hazards associated with them, which includes and
evaluation of the means and
methods of controlling the hazards, and failed to develop a written safety
program based on the
hazard assessment evaluation.
b) Employer failed to maintain training records of dates of training and
type of training received.
c) While on collection routes, employer failed to maintain a maximum speed
of
10 MPH when
the distance between stops exceeds the 2/10 miles.
d) Employer failed to have readily available the manufacturer's
instruction manual to ensure the
correct operating and work practices.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
(1) Conduct a hazard assessment of the various types of collection and
transportation equipment the employer utilizes and the hazards associated
with
them, which includes an evaluation of the methods of controlling the
hazards
identified in the hazard assessment, such as industry and regulatory
requirements;
instructions for the operation inspection, and maintenance of equipment in
accordance with ANSI Z 245.1-1999, Mobile Waste and Recyclable Materials
Collection, Transportation, and Compaction Equipment Safety Requirements,
9.2.1 (a) and (b).  Develop a written safety program based on a hazard
assessment and evaluation in accordance with ANSI Z245.1 - 1999, 9.2.1,
(c) (d)
and (e), to include procedures for the operation inspection and
maintenance of
equipment, prohibited practices, training requirements and normative
references
to documents, such as operating procedures that are relied upon and may be
required as part of that program.
(2)  Maintain training records of the date(s) of training and the type of
training
received, according to ANSI Z 245.1 - 1999, 9.3.1 - 9.3.3.
Training records to include, but not limited to:
Ensuring employees are properly trained for their assigned jobs,
tasks, and use of related equipment at least upon initial assignmentto a
job or task, with periodic refresher training as necessary to
maintain the required level of competence, and refer employees to,
and have readily available, the manufacturer's instructions
(owner's manual) to ensure that correct operating and maintenance
procedures and work practices are understood and followed.
Ensure training is tailored for individual operations and the type of
equipment utilized including detailed, equipment specific training
for drivers, equipment operators and loaders (helpers).  Training
to include a practical demonstration of equipment operation
appropriate to the requirements of the employee's job duties.
Instruct employees not to use stops when distance between spots
is more than 2/10 mile with a maximum speed of 10 MPH, as
recommended by Environmental Industry Association (EIA),
Manual of recommended Safety Practices RSP 00001-2001,
Section 5.3, Paragraph a-3.
Follow the recommended Safety Practices in EIA manual, Section
5.3 (b) 1-3, "Inspection of Steps", and instruct employees to check
the condition of the steps prior to starting work and look for
broken or damaged parts, sagging or bending and report condition
for repair.
Follow the recommended Safety Practices in EIA Manual Section
5.3 (d) 1-5," While in Motion", and instruct employees to keep a
firm grip on handhold with both hands.
NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM,
FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00
