P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of: employee was exposed to
crushing, struck by,
ejection and tip-over hazards.
a)Main entrance to construction site, on or about January 14, 2010, an
employee
was observed operating a forklift (e.g. Moffett Mounty M5000, S/N 3472) and
was not wearing a seatbelt, exposing the employee to ejection, struck-by
and
crushing hazards.
ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
AMONG OTHER METHODS, TWO FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS:
1.Ensure that employees wear seatbelts while operating fork lifts.
2.National consensus standard ASME B56.1-1993 requires that use of an
operator
restraint system when equipped on a powered industrial truck.
