Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
his employees places and conditions of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a) Air Traffic Control Tower: Employees were exposed to the hazards of
suffocation, burns or
other serious harm or death at the FAA Air Traffic Control Tower located
in Kinston, North
Carolina. The employer failed to follow the approved alternate standard,
FAA Manual 3900.19,
Chapter 12, Life Safety and Fire Protection Requirements for Air Traffic
Control Towers, in
that:
(1) Fire and smoke dampers, fire stop insulation and proper fire stopping
material
essential in preventing combustible gases from moving upward, throughout
each
compartment, or work area had not been installed.
