Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees of Jose Santiago Inc., were exposed to back injuries due to improper lifting techniques while loading merchandises to the company trailers. The employer failed to provide training in proper lifting techniques to the employees. On September 8, 2009 on the Loading docks 1 to 12 of warehouse employees were observed repeatedly were bending forward at the waist to reach products boxes on the pallets and then were throwing boxes to others employees to place them inside the trailers. The weights of boxes were between 1 and 30 pounds. The OSHA 300 Logs of Jose Santiago Inc., show back injuries incidents reported. Hazard: Employees exposed to back injuries by improper lifting techniques. Among other methods, one feasible and acceptable method to correct this hazard is: 1) Raise the height of the bottom level boxes to allow employees to keep the load close to the body. This will minimize bending of the torso. 2) Provide height-adjustable picking equipment so loads can be maintained at a height that minimizes bending at the waist. 3) Educate employees about the hazards of bending while moving heavy loads. 4) Ensure the use of proper lifting techniques. 5) Stack extra empty pallets on the pallet jack to elevate the bottom of the load. Empleados de Jose Santiago Inc., estuvieron expuestos a lesiones de la espalda debido a tecnicas incorrectas de levantamiento mientras cargaban mercancia para los camiones de la compania. El patrono fallo en proveer adiestramiento sobre tecnicas correctas de levantamiento a los empleados. El 8 de septiembre de 2009 en los muelles de carga 1 al 12 del almacen de despacho, empleados fueron observados en varias ocasiones inclinandose de la cintura hacia delante para coger mercancias en cajas colocadas en paletas y luego tiraban las cajas a otros empleados para colocarlas en el interior de los vagones. El peso de las cajas estaba entre 1 a 30 libras. Los registros OSHA 300 de Jose Santiago Inc., evidenciaba incidentes de lesiones de la espalda reportados. Riesgo: Empleados estaban expuestos a lesiones de espalda por tecnicas incorrectas de levantamiento. Entre otros metodos, un metodo factible para corregir esta situacion es: 1) Elevar la altura de las cajas del fondo para permitir a los empleados mantener la carga cerca del cuerpo. Esto reducira al minimo la flexion del torso. 2) Proporcionar equipos de altura regulable para recoger las cargas logrando mantenerlas a una altura que reduzca alminimo la flexion en la cintura. 3) Adiestrar a los empleados sobre los peligros de la flexion, mientras mueven cargas pesadas. 4) Asegurar el uso de tecnicas adecuadas de levantamiento. 5) Apilar paletas extras vacias para elevar otras mas bajas.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees of Jose Santiago Inc., were exposed to falls and feet fractures. On September 8, 2009 at the dispatch area, door #3 of the warehouse employees were observed manually handling merchandise and storing it on trailers. Between the docking area and the trailer there was a difference in heights of 6 and 1/2 inches and there was a gap of 7 inches of separation between docking area and trailer floor where the employees could trip and fall through. The fall was of 4 feet, equivalent to the diference of height between the docking area and the ground level. Hazard: Employees were exposed to tripping and falls. Among other methods, one feasible and acceptable method to correct this hazard is placing a device that makes a bridge between the docking area and the trailer floor. Empleados de Jose Santiago Inc., estaban expuestos a caidas y fracturas de los pies. El 8 de septiembre de 2009, en el area de la bahia, puerta #3 del almacen, empleados fueron observados acarreando mercancia manualmente y almacenandola en vagones. Entre la bahia del almacen y el vagon y el piso del vagon habia una diferencia en altura de 6 y 1/2 pulgadas y habia una separacion de 7 pulgadas entre ellos por donde los trabajadores podrian tropezar y caer. La altura de la caida era de 4 pies, equivalente a la diferencia entre la bahia y el nivel del piso. Riesgo: Empleados estaban expuestos a tropiezos y caidas. Entre otros metodos, un metodo factible para corregir esta situacion es colocar un dispositivo que cree un puente entre la bahia y el vagon.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At the freezer #1 in the warehouse of Jose Santiago Inc., located in Bayamon PR, where employees collected merchandise among other things it was observed that the merchandise was stored on rack systems with visible damage on rack components that compromised their integrity and presented a hazard of merchandise and/or racks falling over the employees. It was documented that the boxes stored on the racks weighted up to 114 pounds and the rack systems meassured 25 feet tall. The following racks were observed with compromised integrity: a) passage #54, localization 001, level A b) passage #55, localization 001, level A c) passage #57, localization 0046, level B d) passage #57, localization 0038, level A Among other methods, one feasible method to reduce this hazard is replace the damaged storage shelving, or stacks merchandise only in the lower level of the rack system. En el refrigerador #1 del almacen de Jose Santiago Inc., localizado en Bayamon PR, donde los empleados acarreaban mercancia entre otras cosas, se observo que la mercancia era almacenada en sistemas de estanteria con danos visibles en componentes de los estantes, lo que comprometia la integridad de los mismos y presentaban un riesgo de que los estantes y/o mercancia cayese sobre los empleados. Se documento que las cajas que almacenaban en los estantes llegaban a pesar hasta 114 libras y que los sistemas del estante midieron 25 pies de alto. Los siguientes estantes fueron observados con la integridad comprometida: a) pasillo #54, localizacion 001, nivel A b) pasillo #55, localizacion 001, nivel A c) pasillo #57, localizacion 0046, nivel B d) pasillo #57, localizacion 0038, nivel A Entre otros metodos, un metodo viable para reducir este riesgo es remplazar los estantes de almacenaje danados o acomodar mercancia solamente en el nivel mas bajo del sistema de estantes.

Hazard: Fatalities, injuries, and illnesses related to domestic violence in the workplace. Among other methods, one feasible and acceptable method to correct this hazard is to establish and implement a written protocol to manage situations of domestic violence at the workplace as required by Act Number 217 of September 29, 2006. The protocol must include the following minimum requirements: a public policy statement, legal basis and applicability, responsibilities of the personnel, and uniform procedures and measures to be followed in order to handle the cases. En la compania Jose Santiago Inc., el patrono no tenia un protocolo escrito de violencia domestica en el lugar de trabajo, requerido bajo la Ley para la Implementacion del Protocolo de Situaciones de Violencia Domestica en el Lugar de Trabajo o Sitio de Empleo, Ley numero 217 del 29 de septiembre de 2006, y la Ley numero 16 del 5 de agosto de 1975 segun enmendada. Riesgo: Fatalidades, lesiones y enfermedades relacionadas a la violencia domestica en el trabajo. Entre otros metodos, un metodo factible y aceptable para corregir este riesgo es establecer e implantar un protocolo escrito para manejar situaciones de violencia domestica en el lugar de trabajo como es requerido por la Ley Numero 217 del 29 de septiembre de 2006. El protocolo debera incluir los siguientes requisitos minimos: declaracion de polotica publica, base legal y aplicabilidad, responsabilidad del personal, y procedimiento y medidas uniformes a seguir en el manejo de casos.
