Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which are free from
recognized hazards that are causing or likely to cause death or serious
physical harm to his
employees in that employees were exposed to:
(a) Auto repair shop: On or about February 25, 2010 and at times prior
thereto, employees
were exposed to struck by and crushing hazards while elevating vehicles
using Challenger
lifts with out functioning locks on the lifting arms.
(b) Auto repair shop: On or about February 25, 2010 and at times prior
thereto, employees
were exposed to struck by and crushing hazards while elevating vehicles
using Challenger
lifts with missing or broken retaining clips on the lifting arm extensions.
(c) Auto repair shop: On or about February 25, 2010 and at times prior
thereto, employees
exposed to struck by and crushing hazards while elevating vehicles using a
Hunter
auto lift
which had leaking hydraulic Cylinders.
(d) Auto repair shop: On or about February 25, 2010 and at times prior
thereto, employees
exposed to struck by and crushing hazards while elevating vehicles using
lifts which were not
inspected for damage such as but not limited to metal fatigue, and worn
and damaged parts.
Abatement Note:
Among other methods, one feasible and acceptable method to correct the
hazards noted is to
follow the requirements in ANSI/ALI ALOIM 2008 which include, among other
requirements, the following:
1.    Institute a preventive maintenance program according to the
manufacturer's
specifications.
2.    Provide training to employees on proper use and care of the lifts.
3.    Schedule and complete all periodic and annual inspections.
Abatement Note:  Abatement certification and documentation is required for
this item.
