Public Law 91-596 Section 5(a)(1) of the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
On December 13, 2007, employees were exposed to crushing and struck by
hazards while
working in an excavation near and under an operating excavator with a
bucket attached to the
machine by a "Quick Latch" quick coupling device that was not equipped
with a safety pin.
Among other methods, feasible and acceptable abatement methods to correct
this include, but
are not limited to the following:  1. Follow the manufacturer's
requirement to secure the safety
pin in the latched position when attaching the bucket with a quick
coupling device.  2.  Ensure
all operators of machines equipped with quick coupling devices are trained
to follow
manufacturers' procedures to assure proper coupling and to recognize if
the
safety pin is
properly secured and/or missing.
Abatement certification is required for this item in accordance with the
requirements of 29 CFR
1903.19(c).
