Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of impalement on vertical objects. a)Five masons were on the west and north sides of a five tier tubular-welded scaffolding and reached heights of approximately 26 feet without guardrails. Below the site were 3 shovels stuck in the ground and a cross-brace that was folded and stuck in the sand pile for the mortar, exposing the employees to an impalement hazard. One method among others to abate this hazard is to pull the equipment out of the ground and move it away from the scaffolding.
