Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of breathing carbon monoxide:
a)  At the site, on the forth floor of an enclosed building, the General
Contractor
provided a gasoline powered generator for the subcontractors to use. The
Generator was in use,
located in one of the hotel rooms and positioned near an open window.
Using a generator
indoors can kill a person in minutes.  Generator exhaust contains carbon
monoxide.  This is a
poison you cannot see or smell.  Providing and allowing subcontractors to
use this generator
indoor exposed the GC and subcontractor to the potential of death.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard is to relocate the generator outdoors.  Only use outside and far
away from windows,
doors, and vents.
