Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by heavy equipment:
a) On or about September 30, 2008, at the work site, employees were
exposed to a struck
by hazard by heavy equipment such as front end loaders and commercial size
dump trucks that
travel into and throughout the site. An accident occurred when an employee
entered an area of
the work site that was off-limits to pedestrians; barricades were not
erected to prevent the
employee from entering this area.  Among other methods, feasible and
acceptable abatement
methods to correct these hazards are
1. Establish policy whereby equipment operators are required to look in
the direction of, and
keep a clear view of the path of travel.
2. Provide and document training for all equipment operators so they have
a clear understanding
of the policy.
3. Provide and document training for all potentially exposed employees
relevant to the hazards
associated with walking through areas where heavy equipment and other type
of vehicular traffic
are operating.
4. Erect barriers to delineate the hazardous area and prevent unauthorized
entry.
