Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ammonia: (a) Facility: On or about April 17, 2008, the following deficiencies existed in the anhydrous ammonia engine room: (a) There was no alarm to alert employees of an anhydrous ammonia leak. (b) There were at least two anhydrous ammonia leaks. (c) The ceiling was combustible (wood). (d) Anhydrous ammonia piping was being supported by a wooden 2 x 4 and wooden 4 x 4's. (e) There was no self closing door from the anhydrous ammonia engine room into the plant. (f) There were no remote control disconnects for the anhydrous ammonia equipment (compressors, pumps, etc). Among other methods, one feasible and acceptable means of abatement is to repair/upgrade the above areas so that they are in compliance with ANSI/ASHRAE Standard 15-2001.
