Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of 10 feet and more. (a) Neville Island Supply job site, Silo #9: On or about 10/09/08 employees were being lifted onto the damaged platform by the operator of the forklift that was equipped with only a wooden pallet. Additionally, a portable ladder was placed on the pallet and then raised by the forklift operator. This condition exposed workers to falls of 10 feet above ground level. Among other methods, one feasible and acceptable means of abatement would be to utilized a safety platform, attached to the forks, which was approved by the forklift manufacturer and in compliance with ANSI/ASME B56.1-Safety Standard for Low Lift and High Lift Trucks.d
