Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)

that employees
were exposed to serious struck-by and/or crushing hazards while
fabricating steel fuel tanks by
welding.
(a)Employees were exposed to serious struck-by and/or crushing hazards
while
fabricating steel fuel tanks by welding, in that the employer did not
provide clear
and adequate direction as to how employees were to support and brace the
steel
fabrications as they were welded together during the manufacturing
process.
Total weight of fabricated steel tank is approximately 2,000 lbs.
A feasible means of abatement includes, but is not limited to, providing
procedures whereby steel tanks during the fabrication process are welded
to the
metal support horses, which can then be welded to the metal support floor,
thus
providing stability from tipping forces and significantly reducing the
likelihood
of a resulting serious struck-by and/or crushing hazard.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
