Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of not wearing seatbelts while operating powered industrial trucks: (A)Fabrication: On March 3, 2008, and at times prior thereto, employees were not required to wear seatbelts while operating the Nissan Optimum 50 forklift. Note 1: Amongst other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of seatbelts when operating forklifts (powered industrial trucks) throughout the establishment as required by ANSI/ASME B56.1. Note 2: Abatement certification is required for this item.
