Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of falling approximately two stories to the ground:
a.Job site On or about 5/12/09, employees working on the platform affixed
to the
forks of an Sky Trak Rough Terrain forklift were not protected from falls.
The
employees were not wearing harnesses with lanyards attached to an anchor
point
and the platform did not have railings (top rail and midrail) on three of
the four
sides. The platform was approximately 20 feet above the ground.
ABATEMENT NOTE: Among other methods, one feasible and acceptable means
of abatement would be to provide harnesses for the employees and to comply
with
the requirements of the American National Standards Institute (ANSI) B56.6
