Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees exposed to
crushing and / or struck by hazards in the event of being thrown from the
tractor..
(a) Amalgamated Leasing dba Bluffton Flying Service:  On or about July 23,
2008, at
1080 Navajo Drive, Bluffton, Ohio, an employee was operating a Massey
Ferguson,
MF-255, tractor without wearing the installed restraint device (seat
belt), was thrown
from the tractor, and was caught under the tires of the tractor and the
heavy duty
flailtype grass mower. The seat belt in the tractor was a component of an
operator
restraint system that is designed to reduce the incidence and severity of
injuries to the
operator in the event of a roll-over accident.
Among other methods, one feasible and acceptable method of abatement to
correct
this hazard is to require and enforce all employees to use the seat belt
when operating
the Massey Ferguson, MF-255, tractor as stated in the Operator's Manual
In accordance with 29 CFR 1903.19(d), abatement certification is required
for
this violation (using the CERTIFICATION OF CORRECTIVE ACTION
WORKSHEET), and in addition, documentation demonstrating that abatement is
complete must be included with your certification.  This documentation may
include, but is not limited to, evidence of the purchase or repair of the
equipment, photographic or video evidence of abatement, or other written
records.t,
