Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that an employee was
exposed to crushing injuries while
operating excavator without wearing seat belts:
(a)Kanawha Blvd. & Haddad River Front Park: The operator of the small
Kubota KX 91-3
excavator did not utilize the seat belt as he drove the machine with the
hoe ram attachment in
the bucket from one end of the project to the other end of the project
behind the trailer as
observed on 5-25-10.
Among other methods, one feasible and acceptable abatement method to
correct these hazard is
to ensure all earth moving equipment has an operable seat belt and to
train employees and
effectively enforce the use of seat belts when the equipment is provided
by
the manufacturer.
