Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 1/24/08 at the back dock; fork truck operator engaged in removal of stuck dock plate was not wearing or using the seat belt restraint system provided on the Mitsubishi fork exposing him to a crushing hazard of falling off or being struck by fork truck. Feasible and acceptable abatement methods to correct this condition would be; require seat belt use by fork truck drivers, establish regular supervisor checks of seat belt use by fork truck operators and include this requirement as part of plant fork truck operating rules. Reference: ASME B56.1-1993, Part II, pg 12 paragraph 5.3.19 ( An active operator protection device or system, when provided, shall be used.) ABATEMENT DOCUMENTATION REQUIRED
