Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the hazards of being struck by
vehicular traffic.
a/ At the job site, employee(s) were exposed to the hazard of being
struck by vehicular traffic due to the
employer's failure to place traffic control signs or barricades along the
east and west bound lanes of Castleman
Avenue. Employees were excavating a trench approximately 13 feet long
into the street and operating a
Caterpillar Backhoe effectively blocking the west and east bound lanes
respectively.
One method of abatement to correct this apparent hazard is to post
suitable traffic control signs or barricades
as required by Part VI, Section 6C.03, of the Manual Uniform Traffic
