Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to improperly maintained exterior walking/working surfaces: A)On or about December 16, 2010, and times prior thereto, employees were exposed to slip and fall hazards from snow/ice covered areas and ice filled potholes. These areas included, but were not limited to, the employee parking area, the school bus parking area, the fuel pump area, and employee walkways. B)On or about December 16, 2010, and times prior thereto, employees were exposed to trip and fall hazards from the presence of pot holes. These areas were the pot holes were located included, but were not limited to, the employee parking area, the school bus parking area, the fuel pump area and employee walkways. ABATEMENT NOTE: Among other means, acceptable and feasible methods to correct the conditions include: Create an adequate parking lot surface to limit the trip and fall hazard as well as to facilitate the effective use of surface melting / traction material that will limit the slip and fall hazards. The suitable surface could be established with stone that it compacted correctly, pavement, or concrete. Fill-in the potholes to eliminate the trip/fall hazards and to eliminate the accumulation of water and ice. Institute a regular inspection program for exterior walking/working surfaces such as bus parking area, employee parking area, fuel pump area, and exterior walkways. The inspection program should be designed to identify slip, trip, and fall hazards associated with standing water, pot holes, and snow/ice. Establish snow/ice removal plan for exterior walking/working surfaces such as bus parking area, employee parking area, fuel pump area, and exterior walkways. Increase the application of sand and/or other anti-skid material based on weather conditions and the inspections of exterior walking/working surfaces.orking
