Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
a)The hazard of being struck-by a dropped load in the repair workshop
area, a
Budgit 1-ton electric hoist and jib crane, installed on a metal leg of an
elevated
storage silo, which had no rated capacity, and which was installed without
evaluation by a qualified engineer.
b)The hazard of being struck-by a dropped load in the repair workshop
area, a
Budgit 1-ton electric hoist and jib crane, installed on a second metal leg
of an
elevated storage silo, which had no rated capacity, and which was installed
without evaluation by a qualified engineer.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is installing a jib crane and hoist on a supporting structure
designed to withstand
the loads and forces imposed by the hoist for the raised load, as
specified by Section 16-
1.3.2 of ASME B30.16-1998 Safety Standard for Cableways, Cranes, Derricks,
Hoists,
Hooks, Jacks, and Slings, entitled OVERHEAD HOISTS (UNDERHUNG), published
by The American Society Mechanical Engineers.
DISCLAIMERS:1)You are not limited to the abatement methods suggested
above.
2)The methods explained are general and may not be
effective in all cases.
3)The employer is responsible for selecting and carrying out
an appropriate abatement method.nt
