Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries: a) On or about October 1, 2008 and times prior, employees operated forklifts while not wearing a seat belt exposing them to serious injuries in the event of a tip-over or other accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are trained regarding the hazards associated with not wearing seat belts and to implement an active, effective enforcement policy.ment

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to injuries due to falls: a) On or about October 1, 2008 and times prior, employees were exposed to serious injuries from falls while sorting produce while standing on a ladder and not maintaining three point contact with the ladder. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are working from a stable work platform.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries: a) On or about October 1, 2008 and times prior, employees were exposed to serious injuries from being caught in the rotating chain and sprocket located on the hopper. b) On or about October 1, 2008 and times prior, employees were exposed to serious injuries due to repair and maintenance on equipment while the equipment was not de- energized (locked-out). Among other methods, one feasible and acceptable abatement method to correct this hazard is to install the machine guards and locks designed to prevent employees from getting caught in the chain and sprocket.

The 220 volt main control panel was missing a breaker exposing employees to an energized bus bar. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install the missing breaker or a blank designed for this purpose.
