Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: a) Employees were exposed to the hazards of suffocation, burns or other serious bodily harm or death in the Air Traffic Control Tower at the FAA Air Traffic Control Tower located in Key West, Florida. The agency head failed to follow the approved alternate standard, FAA Manual 3900.19, Chapter 12, Life Safety and Fire Protection Requirements for Air Traffic Control Towers, in that: 1) Install fire and smoke dampers, fire stop insulation and proper fire stopping material essential in preventing combustible gases from moving upward, throughout each compartment, or workarea. 2) The fire evacuation plan and fire alarms were not comprehensive and, it also did not instruct personnel to use periodic fire drills were not held at (a minimum of one drill annually). Among other methods, one feasible and acceptable abatement method to correct these hazards is to follow prior abatement agreement between OSHA and FAA and to assure physical inspection for compliance. The NFPA, Joint Commission, ICC, and Underwriters Laboratories, Inc., requires periodic inspections of fire and smoke dampers to ensure that the dampers are operable.
