Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries: On or about 10/06/2008, at 10943 NW 122nd Street, in Medley, Florida, in the warehouse area, an employee was operating a Clark powered industrial truck with no seat belt. One feasible and acceptable means of abatement is to follow the recommendations of the manufacturer as provided on the warning label that states that the lift truck operator must wear a seat belt during operation. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
