Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees engaged in curbside related
activities were
exposed to struck-by and caught-between hazards:
On or about 11/17/2008, along Fairview Road, in the city of Palm Beach,
Florida, a 310SE John
Deere backhoe/loader with an obstructed view to the rear and with no rear
view mirrors was
operated in reverse and in close proximity to employees installing
curbside formwork.
Among other methods, a feasible and acceptable means of abatement is to
follow the
recommendations of the manufacturer and to install an interior rear view
mirror.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.
