OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On February 2, 2015, at the above addressed site, an employee was exposed to potential struck-by hazard when working adjacent to load being lifted by a piece of excavating equipment while the load was not rigged in a manner that would keep it under control at all times and while the lifting device was kept directly over the center of gravity of that load.

29 CFR 1926.251(a)(1): Defective rigging equipment was not removed from service:   On February 2, 2015, at the above addressed site, an employee was exposed to a struck by hazard when working with a steel hook mounted on the bucket of an excavator used for material handling that was defective and not removed from service.
