Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard in the event of a forklift tipover.
a) Establishment
The employer failed to require all warehouse employees to wear seat belts
while operating
Toyota forklifts, thereby exposing the employees to a crushing hazard in
the event of a forklift
tipover.
Violation observed on or about 6/12/08.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is
to establish and enforce the requirement for operators of powered
industrial
trucks which are
equipped with seat belts to use the devices as stipulated in the current
versions of ANSI B56.1,
consensus standard for powered industrial trucks.
