Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by flying parts ejected from the machine
during the operational
cycle:
(a) Shop area: Employees working at or near the Okuma LB-15 CNC lathe, s/n
A451, were exposed to the hazards of being struck by ejected parts. The
employer did not ensure that employees operating the lathe were not
standing in
front of the door/shield during machine operation, despite having
knowledge that
parts had become loose from the chuck during lathe operation in the past.
On or
about 7-31-09, an employee was fatally injured when he was struck by a part
which was ejected from the machine and not contained by the front door.
Feasible abatement methods include but are not limited to the following:
1.  To abide by the manufacturers' recommendation and warning, which
states "Do not stand
in front of the door during machine operation."
2.  To institute adequate work rules and employee training to establish
normal operation and
emergency shutdown procedures which do not place the employee in front of
the door during
machine operation.
