Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm:
On or about June 29, 2009 at the 1308 E. Hwy 152, Mustang, Oklahoma
worksite:  On or
about June 29, 2009, Pinion Design and Contracting employees were
performing steel
erection from a Skytrak 8042 telehandler with a work platform that
inadequately designed per
manufacturer's instructions exposing employees in the following instances:
1)Work platform was missing toeboards exposing employees to the hazards of
being
struck by tools and equipment.
2)Work platform was attached to the forklift by a come-along which exposed
employees
to the hazards of falls.
3)Forklift tilt feature was not disabled exposing employees to the hazards
of falls.
A feasible means of abatement is to construct a work platform meeting the
requirements of
ASME B56.6-2002 Section 8.24.
