North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm in that
employees were exposed to fall and struck-by hazards:
a) jobsite, the elevated work platform used with a Lull Highlander
forklift did not meet the
design, construction and use requirements as outlined in ASME B56.6 &
Section 8.24.1(b), by
extending approximately 43 inches beyond the load bearing tires.
Among other methods, one feasible and acceptable means to correct these
hazards are to use a
safer alternative method such as the use of a platform meeting the
requirements of ASME
B56.6-2002, Section 8.24.1(b), Platforms for Elevating Personnel.
