North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by object hazard. a)Shop area (Bay #1) - where the operating instructions, general safety information, and safety tips and warning labels for the in-ground "Curtis" automotive lift were not displayed in a conspicuous location in shop area. Reference:ANSI/ALI - 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ANSI/ALI ALCTV- 1998 (Section 4.2.2): requires the lift manufacturer to supply operating instructions, general safety information, safety tips and warning labels with each lift manufactured. The owner or employer shall display these materials in a conspicuous location in the lift area. ABATEMENT NOTE: One feasible and acceptable method of abatement is for the employer to post the operating instructions, general safety information, and warning labels in a visible location in the Shop area (preferably in Bay #1) for employee review.

Reference: ANSI/ALI - 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ANSI/ALI - 2000 (Section 4.3): Operator Training Documentation. The owner or employer shall appropriately document operator training by completing the operator training log found in the appendix to this standard. ABATEMENT NOTE: One feasible and acceptable method of abatement is for employees operating the lift be trained by a qualified instructor Operator training for employees should be documented on the Appendix -A form as required by ALI ALOIM -2000 paragraph 4.2 to operate the lift.te

Reference: ANSI/ALI - 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ANSI/ALI - 2000 (Section 4.4.1) The operator shall operate the automotive lift only after being properly instructed or trained in accordance with this standard and manufacturer supplied instructions. ABATEMENT NOTE: One feasible and acceptable method of abatement is for qualified personnel to properly instruct or train in accordance with ANSI/ALI - 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts and manufacturer supplied instructions.

Reference: ANSI/ALI - 2000 (American National Standards Institute/Automotive Lift Institute) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ANSI/ALI-2000 (Section 4.4.4) The lift owner or employer shall take all appropriate steps to follow the recommended inspection procedure of the lift manufacturer, but in no event shall the lift operator fail to inspect or take notice of the following features on a daily basis: (1) accessibility and readability of the operating procedures, safety tips and generic safety material; (2) accessibility and readability of safety warning labels; (3) readability of the rated load capacity of the lift; (4) proper operation of the lift controls, restraints and locking devices; ABATEMENT NOTE: Acquire daily and weekly inspection check sheets for the equipment through the dealer and employ and enforce a documented inspection program to ensure that defected equipment can be immediately identified.
