Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
On or about 8/13/09 at 364 Wilmington Pike Glen Mills, PA -Employees were
exposed
to a fall hazard from approximately 8 feet above ground level while
nailing plywood on
a building's facade, from a JBC telescoping Forklift Model 530, that did
not have
restraining means such as guardrails on the open sides.  A feasible means
of abatement
is to install such restraining means or use an aerial lift, or use a
scaffold with guardrails.
