Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to possible fall, crush and amputation hazards while being lifted on the forks of powered industrial truck(s): Warehouse employee(s) were lifted approximately 10 feet above concrete floor while standing on the forks of lift truck(s), without utilizing a fall protection system such as an approved lift cage/work platform to place/retrieve merchandise on the rack storage system. Employee(s) being lifted were also exposed to having body parts, such as finger(s), hand(s) and arm(s) becoming caught in the moving parts of the forklift while being lifted or lowered. Feasible means of abatement would be to comply with: 1.The American National Standards Institute/American Society of Mechanical Engineers Standard ANSI/ASME B56.1 - 2005, "Safety Standard for Low Lift and High Lift Trucks." Section 4.17 General Safety Practices - Elevating Personnel provides that whenever a truck is used to elevate personnel, the following precautions shall be taken: (a) comply with design requirements; (b) provide protection from moving parts; (c) proper placement of and use of restraining means; (d) assure smooth operation of the lifting mechanism and functionality of limiting devices and latches; (e) overhead protection; and, (f) replacement of restraint/fall protection when damaged. 2.Comply with manufacturer's operating instructions and hazard warnings. Yale posts, within their operator's manuals and on the sides of the mast, warning signs that state, "Keep yourself and all others clear of the lift mechanism. Never allow anyone under or on the forks." Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
