Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: Employees working in the pelletizing plant were exposed to fire and explosion hazards for the following instances: a)Employees were exposed to fire and explosion hazards created by combustible dusts generated in the process of making fuel pellets in that a dust collection system was not used. Among other methods, one feasible and acceptable method to correct this hazard is to install a dust collection system as referenced in NFPA 654, Prevention of Fire and Dust Explosions of Combustible Particulate Solids, 2006 Edition, paragraph 8.1.1 Fugitive Dust Control "Continuous suction to minimize the escape of dust shall be provided for processes where combustible dust is liberated in normal operation." b)Employees were exposed to fire and explosion hazards created by exhaust fan installed on the west wall to pull dust out of the building. Among other methods, one feasible and acceptable method to correct this hazard is to not use the exhaust fan a means of dust control. NFPA 654, Prevention of Fire and Dust Explosions of Combustible Particulate Solids, 2006 Edition, paragraph 7.12.2.1 Combustible Particulate Solids, states "Where an explosion hazard exists, systems shall be designed in such a manner that combustible particulate solids do not pass through an air-moving device." 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
