Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to f urnish employment and a place of employment which was free from recognized hazar ds that were causing or likely to cause death or serious physical harm to his em ployees: The employer did not ensure that a forklift was used in accordance with manufacturer's specifications as follows: a.Located at 1100 East Colton Avenue, employees were using a Clark forklift Serial # G138MB-0783-6831FA, Model # - GC S30MB with a platform to elevate personnel to a height of approximately 10 feet. The manufacturer specifically warns against using the general duty forklift as a personnel hoist. Employees using the forklift contrary to manufacturer's warni ngs and advisories were subject to death or serious physical harm. Reference - C lark Employer's Guide to Material Handling Safety, Personnel Elevators, Page 16, "Lift trucks are not designed to lift people. Elevating personnel on a lift truck is not recommended at any time, and can lead to serious injury o r death." Reference - Clark Employer's Guide to Material Handling Safety, Page 1 7, "Again, Clark Recommends lifting personnel only on machines designed for the job." Reference - Clark Dealer Information System, "Again, Clark strongly advise d against the use of lift trucks as personnel elevators." Feasible Abatement - O ne feasible means of abatement would be to follow the manufacturer's guidelines stated in the Clark Employer's Guide to Material Handling Safety.
