Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to a struck-by
hazard from
compressed gas cylinders:
On or about 04/27/09, at the Port Everglades, a 6 kg carbon dioxide
cylinder was moved
without the valve cap in place and without using a hand truck or similar
device.
Among other methods of abatement, one feasible and acceptable method to
correct the hazard
is to move the cylinders using a hand truck and placing the valve
protection cap as recommended
by the Compressed Gas Association Pamphlet P-1-1965.
